29 CFR 1910.178(a)(6): The employer did not ensure that all nameplates and markings were in place: a) Employees were exposed to struck by the load hazards from the Clark Propane Outdoor forklift. There is no serial plate such as, but not limited to the Clark Propane Outdoor forklift. This makes it difficult for operators to know the specifications and restrictions of the equipment creating the potential for operators to attempt to lift loads that exceed the capabilities of the forklift.

29 CFR 1910.178(p)(1): Powered industrial truck(s) found to be in need of repair, defective, or in any way unsafe had not been taken out of service until restored to safe operating condition(s): a) Employees were exposed to struck by hazards such as the Caterpillar GP50K the parking brake was not working. The Caterpillar GP50K forklift had not been taken out of service until it was in safe operating condition. b) Employees were exposed to struck by hazards such as but not limited to the Caterpillar V80D forklift had a brake pedal without a nonskid cover. The Caterpillar V80D forklift that did not have a Caterpillar marking on exterior of the forklift had not been taken out of service until it was in safe operating condition. c) Employees were exposed to struck by hazards such as the Caterpillar V140 Diesel forklift did not have a working horn, and there was no nonskid cover on the brake pedal. The Caterpillar V140 forklift was not taken out of service until it was in safe operating condition.
