29 CFR 1926.602(a)(9)(ii): The employer permitted earthmoving or compacting equipment which had an obstructed view to the rear to be used in reverse gear without a reverse signal alarm distinguishable from the surrounding noise level or an employee signals that it is safe to do so:    (a)Dahme Construction Co., Inc. at 3rd Avenue, Miller, SD 57362: On or about and at times prior to November 7, 2018, the employer did not ensure employees were protected from struck-by hazards while working near the John Deere 350G LC excavator without an operable reverse signal alarm. This condition exposed employees to struck-by hazards.

29 CFR 1926.651(c)(2): A stairway, ladder, ramp or other safe means of egress was not located in trench excavations that were 4 feet (1.22m) or more in depth so as to require no more than 25 feet (7.62m) of lateral travel for employees:    (a)Dahme Construction Co., Inc. at 3rd Avenue, Miller, SD 57362:  On or about and at times prior to November 7, 2018, the employer did not ensure that a safe means of egress was provided to employees within a protective system in an excavation greater than four feet deep. Employees were working in an approximately six and a half foot deep excavation with no means of safe egress. This condition exposed employees to not having a safe means of egress from the excavation.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:    (a)Dahme Construction Co., Inc. at 3rd Avenue, Miller, SD 57362:  On or about and at times prior to November 7, 2018, the employer did not ensure that the ladder being used for access to the excavation was used in accordance with manufacturer's recommendations. Employees were using a Werner 24-foot extension ladder, Model# D1224-2, that was separated and employees used the top section of the extension ladder for access/egress from the excavation. This condition exposed employees to fall hazards while using the top section of an extension ladder for access/egress from an excavation.

29 CFR 1926.652(c)(3)(iii): At least one copy of the tabulated data, which identifies the registered professional engineer who approved the data, was not maintained at the jobsite during construction of the protective system:    (a)Dahme Construction Co., Inc. at 3rd Avenue, Miller SD, 57362: On or about and at times prior to November 7, 2018, the employer did not ensure that at least one copy of the tabulated data was maintained at the job-site. The employer could not produce at least one copy of tabulated data for five trench shielding systems being used at the job-site. This condition exposed employees to struck-by and cave-in hazards as a result of not using the correct protective system based on a competent person evaluation of the soil conditions.
