29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section: The employer is failing to protect employees from struck by and crushing hazards associated with employees maintaining equipment without written procedures for securing hazardous energy sources including but not limited to electrical, kinetic and gravity. The most recent occurrence was evident on November 7, 2018 during the investigation located at Mile Marker 368 Westbound Interstate 80 fifteen miles East of York, Nebraska, where the employer had employees repairing a disabled tractor/trailer without written specific procedures. While working on the equipment the employee was ran over by the rear tandem wheels of the trailer suffering fatal injuries.

29 CFR 1910.178(l)(2)(ii): The employer did not ensure that each operator had successfully completed the training consisting of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace. The employer is failing to ensure that all employees operating powered industrial trucks at the facility have received adequate training as outlined in this paragraph of the standard. The most recent occurrence of this was evident in the inspection conducted on November 7th 2018 at 4700 S. Lincoln Ave., York, Nebraska. Some employees have not been provided the "hands-on" portion of the training prior to being allowed to operate powered industrial trucks in the facility. By accomplishing this training, employees would be able to understand the hazards of operating these vehicles.

The most recent occurrence of this was evident during the inspection on November 7th 2018 at the facility located at 4700 S. Lincoln Ave., York, Nebraska where the employer inadequately trained employees using various hazardous within the scope of their duties without having provided them specific training on the HAZCOM program and Safety Data Sheets.
