29 CFR 1910.147(d): The established procedure for the application of energy control (the lockout or tagout procedures) did not cover the actions listed in and was not done in sequence as required by 29 CFR 1910.147(d)(1)-(6):    On or about November 13, 2018, employees who conducted service and maintenance activities including, but not limited to, setting up the cutting area and inspecting the cutting nozzle were exposed to machine hazards associated with high pressure water streams. Although the machine machine's pumps were shut down at the computer to perform the servicing work, the remaining applicable energy control elements involving machine isolation [(d)(3)], LOTO device application[(d)(4)], dissipation of residual energy [(d)(5)(i)], and verification of isolation [(d)(6)], were not implemented to protect employees from machine servicing hazards.

The employer failed to provide these authorized employees training in the recognition of applicable hazardous energy sources, the type and magnitude of the energy available in the workplace, and the methods and means necessary for energy isolation and control for equipment such as, but not limited to, the Ward Jet water cutter which employees enter during set up and break down exposing them to energy sources including, but not limited to, electricity, hydraulics, and pneumatics.

29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    On or about November 13, 2018, employees were exposed to electrical, pneumatic, and hydraulic hazards associated with high pressure water jet streams when they entered the Ward Jet water jet to remove finished parts. The employer failed to provide adequate machine guarding to protect the operator, as employees could reach over and climb over the guard in place to enter the machine.
