29 CFR 1926.1408(a)(2): The employer did not determine if the equipment's maximum working radius could get closer than 20 feet to a power line by meeting the requirements in Option (1), Option (2), or Option (3) of this section: (a) On or about October 26, 2018 for the employee exposed to electrical shock hazards where a Terex Telelect Digger Derrick was lifting a light pole for installation that swung into high voltage power lines on Highway 2, two miles north of Williston, North Dakota.

29 CFR 1926.1408(a)(2)(iii)(B): Where it was determined that any part of the equipment, load line or load (including rigging and lifting accessories), while operating up to the equipment's maximum working radius in the work zone, could get closer than the minimum approach distance of the power line permitted under Table A (see � 1926.1408), the requirements in paragraph (b) of this section were not met: (a) On or about October 26, 2018 for the employee exposed to electrical shock hazards where a Terex Telelect Digger Derrick was lifting a light pole for installation that swung into high power lines on Highway 2, two miles north of Williston, North Dakota.
