Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: (a) On November 14, 2018, and at times prior for the employee exposed to a ten foot fall hazard who was elevated on the forks of a CAT TH514C Telehandler while conducting concrete activities with no fall protection in the vicinity of 26th Avenue South & 41st Street South in Fargo, North Dakota. Abatement Note: Among other methods of abatement, one feasible and acceptable method to correct the hazard is to follow the requirements of the manufacturers recommendations for machine operation which clearly state, Lift or lower personnel only in an approved work platform.
