29 CFR 1926.1412(e)(1): The equipment in service was not inspected each month in accordance with paragraph (d) of this section (each shift). a) Govea Construction located at 151 S. 8th Street, Berthoud, CO 80513: On and preceding November 15, 2018, the employer did not ensure that an inspection was performed each month that the crane was in use. A Freightliner BT3400 Terex Stinger mobile crane was being utilized to hoist trusses and gables in place which weighed up to approximately 1600lbs, and monthly inspections had not been performed. This condition exposed employees to struck-by hazards.

29 CFR 1926.1412(f)(1): The equipment was not inspected at least every 12 months by a qualified person in accordance with paragraph (d) of this section. a) Govea Construction located at 151 S. 8th Street, Berthoud, CO 80513: On and preceding November 15, 2018, the employer did not ensure that an inspection was performed at least every 12 months by a qualified person during the timeframe that the crane was in use. A Freightliner BT3400 Terex Stinger mobile crane was being utilized to hoist trusses and gables in place which weighed up to approximately 1600lbs, and the crane did not have annual inspections. This condition exposed employees to struck-by hazards.

29 CFR 1926.1425(c)(1): 29 CFR 1926.1425(c)(1): The employer did not make sure that the materials being hoisted when employees were hooking, unhooking, or guiding the load were rigged to prevent unintentional displacement. a) Govea Construction located at 151 S. 8th Street, Berthoud, CO 80513: On and preceding November 15, 2018, the employer did not ensure that the materials being hoisted when employees were hooking, unhooking, or guiding the load were rigged to prevent unintentional displacement. A Freightliner BT3400 Terex Stinger mobile crane was being utilized to hoist trusses and gables in place which weighed up to approximately 1600lbs. One of the cables being used to hoist the gable became displaced, fell, and struck an employee. This condition exposed employees the hazard of being struck-by falling loads.

29 CFR 1926.1428(a): The employer of the signal person must ensure that each signal person meets the Qualification Requirements (paragraph (c) of this section) prior to giving any signals. This requirement must be met by using either Option (1) or Option (2) of this section. a) Govea Construction located at 151 S. 8th Street, Berthoud, CO 80513: On an preceding November 15, 2018, the employer did not ensure that the signal person was qualified prior to giving signals. A Freightliner BT3400 Terex Stinger mobile crane was being utilized to hoist trusses and gables in place which weighed up to approximately 1600lbs. A signal person was on the second floor of the building giving signals to the crane operator. The signal person was not qualified through the use of a third party evaluator or an employer qualified evaluator. This exposed employees to struck-by hazards.
