29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person.    (a)TaylorMade Exteriors at 909 South Torrey Pine, Sioux Falls, SD 57110:  On or about and at times prior to November 16, 2018 the employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person.       Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     (a)  TaylorMade Exteriors at 909 South Torrey Pine, Sioux Falls, SD 57110: On or about and at times prior to November 16, 2018 the exposing employer did not ensure employees that were working from height while engaged in roofing activities on a residential property were protected from falls using a fall protection system.  This condition exposed employees to a fall hazards above six feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:  (a) TaylorMade Exteriors at 909 South Torrey Pine, Sioux Falls, SD 57110:  On or about and at times prior to November 16, 2018 the exposing employer did not ensure that each employee engaged in roofing operations on a residential property, had been trained to recognize the hazards associated with working at elevations over 6'. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet.

29 CFR 1926.1053(b)(1): Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder.      (a) TaylorMade Exteriors at 909 South Torrey Pine, Sioux Falls, SD 57110:  On or about and at times prior to November 16, 2018 the exposing employer did not ensure that each employee was protected from falls from heights in that two employees were utilizing ladders to gain access to the roof that was not extended at least three feet above the upper landing surface.

(a) TaylorMade Exteriors at 909 South Torrey Pine, Sioux Falls, SD 57110:  On or about and at times prior to November 16, 2018 the exposing employer did not ensure that each employee utilizing ladders had been trained to recognize the hazards associated with working with and on ladders. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.  The condition exposed employees to the hazard of falling from elevations over 13 feet.
