29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: (a) New townhome construction located at 278 Cherokee Street, Marietta, GA, (Lot #8) Lower front roof: On or about 11/19/2018, and at times prior, the employer exposed employees to falls of 14-feet, 3-inches to the lower level, in that a fall protection system was not provided to employees engaged in metal roof panel installation. (b) New townhome construction located at 278 Cherokee Street, Marietta, GA, (Lot #10) Lower front roof: On or about 11/19/2018, and at times prior, the employer exposed employees to falls of 13-feet, 1-inch to the lower level, in that a fall protection system was not provided to employees engaged in metal roof panel installation. AAA Metal Works, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1255443, citation number 1, item number 2 and was affirmed as a final order on 10/11/2017, with respect to a workplace located at 615 Leland Parkway, Cumming, GA.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: (a) New townhome construction located at 278 Cherokee Street, Marietta, GA, (Lot #8) Lower front roof: On or about 11/19/2018, and at times prior, the employer did not provide training to each employee working on a 4/12 pitched roof, in that employees were not provided training to recognize, control, or eliminate fall hazards while engaged in roofing activities at eave heights over 13-feet, 2-inches from the lower level.
