29 CFR 1926.453(b)(2)(v): A body belt with lanyard attached to the boom or basket was not worn by employee(s) working from an aerial lift:            a)  On or about 11/19/18, at the Batavia Meadows housing complex located on 4112 West Main Street, in Batavia, New York, an emplyee working from the basket of an aerial lift 14 feet above ground level was not using a harness or lanyard to "tie-off" to the basket for fall protection. Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.       (a)  On or about 11/19/18, at the Batavia Meadows housing complex located on 4112 West Main Street, in Batavia, New York, an employee working on an elevated platform with open sides was not protected against falling 10 feet to ground. 29 CFR 1926.405(a)(2)(ii)(I): Flexible cords and cables shall be protected from damage. Sharp corners and projections shall be avoided. Flexible cords and cables may pass through doorways or other pinch points, if protection is provided to avoid damage.   On or about 11/19/18, at the Batavia Meadows housing complex located on 4112 West Main Street, in Batavia, New York, a flexible cord (extension cord) was not protected from damage while in use to feed electrical power tools.  Construction vehicles and equipment including aerial lifts were in use on site where cords were laid across the work area.  NO ABATEMENT CERRTIIFICATION REQUIRED
