29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, a personal fall arrest system, or an alternative fall protection measure as provided by another provision in paragraph (b) of this section:  a. Employees performing roofing work are not protected from fall hazards by the use of a fall protection system.  The employer fails to assure effective protections against falls as required by the standard, as demonstrated on November 19, 2018, when employees of Jose Arnoldo Espinoza, LLC are working on a residential roof with a 4:12 pitch at 1364 Lamboll Avenue, Jacksonville, Florida, and are exposed to a 10 feet fall hazard to the ground in that they are not attached to a personal fall protection system.  J Rogero Construction, Inc. was previously cited for a repeat violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(11), which was contained in OSHA inspection number 1316857, citation number 02, item number 002 and was affirmed as a final order on July 27, 2018, with respect to a workplace located at 5627 Atlantic Blvd., Jacksonville, FL 32207.  J Rogero Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1298449, citation number 01, item number 002 and was affirmed as a final order on April 10, 2018, with respect to a workplace located at 12767 Bentwater Drive, Jacksonville, FL 32225.
