29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures:    a) Work site was located at 576 56th Street, West New York, NJ 07093    Employees were exposed to crushing hazards while they performed plumbing tie in work in a 57 inch deep excavation cut in previously disturbed soil with accumulated water near undermined sidewalks.    Violation was observed on or about November 21, 2018.

29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary:    a) Work site was located at 576 56th Street, West New York, NJ 07093    Employees were exposed to crushing hazards while they performed tie in work in a trench with spoil piles placed on top of the undermined sidewalk.  The 57 inch deep excavation was cut in previously disturbed soil and had accumulated water.    Violation was observed on or about November 21, 2018.

29 CFR 1926.651(k)(2): Where the competent person found evidence of a situation that could result in possible cave-in, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions, exposed employee(s) was/were not removed from the hazardous area until the necessary precautions have been taken to ensure their safety.    a) Work site was located at 576 56th Street, West New York, NJ 07093    The designated competent person in charge observed potential cave in hazards as the 57 in. deep trench had accumulated water and spoil piles placed on undermined sidewalks.  Employees were not removed from the trench but allowed to work under such conditions.      Violation was observed on or about November 21, 2018.
