29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: This violation occurred on September 18, 2018 when the employer did not develop and administer a hearing conservation program as described in 29 CFR 1910.95(c) through (o) for employees exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 85 decibels: (a) An Edger was exposed to continuous noise levels at 222.6% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 222.6% is approximately 95.7 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 84.8 dBA to account for the extended shift of more than 8 hours; (b) A Stacker was exposed to continuous noise levels at 186.4% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 186.4% is approximately 94.4 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 84.9 dBA to account for the extended shift of more than 8 hours; (c) A Laborer was exposed to continuous noise levels at 134.5% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 134.5% is approximately 92.1 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 85.0 dBA to account for the extended shift of more than 8 hours; (d) An operator/forklift operator was exposed to continuous noise levels at 102.3% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 102.3% is approximately 90.1 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 85.0 dBA to account for the extended shift of more than 8 hours; (e) A Laborer was exposed to continuous noise levels at 170.9% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 170.9% is approximately 93.8 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 85.0 dBA to account for the extended shift of more than 8 hours; (f) A Laborer was exposed to continuous noise levels at 147.6% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 147.6% is approximately 92.8 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 85.0 dBA to account for the extended shift of more than 8 hours; (g) A Laborer was exposed to continuous noise levels at 75.4% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 75.4% is approximately 87.9 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 85.0 dBA to account for the extended shift of more than 8 hours.
