29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section: a) At 736 Summerlin Dr. Summerlin Subdivision, Auburn, Alabama: On or about November 26, 2018 and at times prior; the employer allowed his employees to install siding from a pump jack scaffold without fall protection exposing his employees to a fall hazard of 18 feet to the ground below.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: a) At 736 Summerlin Dr. Summerlin Subdivision, Auburn, Alabama: On or about November 26, 2018 and at times prior; the employer allowed his employees to use an extension ladder to get on and off the scaffold platform and the rails of the ladder did not extend three feet above the landing to provide safe access exposing his employees to a fall hazard of 18 feet to the ground below. THE NICOLAS HERNANDEZ GARCIA DBA NICOLAS HERNANDEZ GARCIA WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.1053(B)(1) WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1125321, CITATION NUMBER 1, ITEM NUMBER 3, AND WAS AFFIRMED AS A FINAL ORDER ON MARCH 16, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 9612 CHALLIS DRIVE, PIKE ROAD, ALABAMA.
