29 CFR 1910.147(c)(4)(i): Procedures shall be developed, documented and utilized for the control of potentially hazardous energy when employees are engaged in the activities covered by this section: a) On or about November 28, 2018, employees exposed to rotating parts and in-running nips point while engaged in machine setup/adjustments on a CT pouch machine, due to the fact the employer did not implement an energy control procedure. b) On or about November 28, 2018, employees exposed to rotating parts and in-running nips point while engaged in machine setup/adjustments on the large Mamata press, due to the fact the employer did not implement an energy control procedure.

29 CFR 1910.147(d): Application of control. The established procedures for the application of energy control (the lockout or tagout procedures) shall cover the following elements and actions and shall be done in the following sequence: a) On or about November 28, 2019 employees were exposed to machine hazards associated with pinch point hazards from moving parts when they were engaged in servicing and maintenance activities on the CT machine. The employer did not ensure that energy control application steps to control the electrical energy sources were implemented prior to allowing employees setting up and/or webbing the machine. The machine was not shut down or turned off prior to engaging in these servicing and maintenance activities. b) On or about November 28, 2019 employees were exposed to machine hazards associated with in-running nip point and shear point hazards from moving parts when they were engaged in servicing and maintenance activities on the large Mamata machine. The employer did not ensure that energy control application steps to control the electrical energy sources were implemented prior to allowing employees setting up and/or making adjustments on the machine. The machine was not shut down or turned off prior to engaging in these servicing and maintenance activities. As a result, the remaining applicable energy control elements, involving machine isolation [1910.147(d)(3)], lockout/tagout device application [1910.147(d)(4)], dissipation of residual energy [1910.147(d)(5)(i)], and verification of isolation [1910.147(d)(6)] were not implemented to protect employees from machine servicing hazards.

29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices, electronic safety devices, etc.: On or about November 28, 2018 the side panel on the Tin Tie machine was missing that exposed an in-running nip point created by a belt and roller at the infeed area of the machine.

29 CFR 1910.212(a)(3)(ii): The point of operation of machines whose operation exposes an employee to injury, shall be guarded. The guarding device shall be in conformity with any appropriate standards therefor, or, in the absence of applicable specific standards, shall be so designed and constructed as to prevent the operator from having any part of his body in the danger zone during the operating cycle: a) On or about November 28, 2018 the box machine/large Mamata machine was not guarded to prevent employees from accessing in-running nip points from unguarded rollers and shear point hazards from rotating blades during operation. The light curtains installed on the machine were not functioning. b) On or about November 28, 2018 small Mamata machine was not guarded to prevent employee exposure to rotating parts and/or in-running nip point hazards. The interlock switches on the adjustable doors were not functioning.
