29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:  a.  On or about November 20, 2018, at the jobsite, subcontractor employees installing roof trusses, on a 4-story apartment complex, were allowed to stand on the top plate and in the trusses without fall protection, thus exposing the employees to a fall hazard between 9 feet and 41 feet.  b. On or about November 20, 2018, at the jobsite, subcontractor employees installing OSB sheathing on a 4/12 pitched roof, of a 4-story apartment complex, were not protected from falling approxmailety 41 feet to the ground below.

29 CFR 1926.502(k)(1): A fall protection plan was not prepared by a qualified person and developed specifically for the site where the leading edge work, precast work, or residential construction work was being performed:  a.  On or about 11/28/2018, at the jobsite, the employer, directed subcontractor employees from Padilla Stucco to follow a written Fall Protection Program that was not designed specifically for the jobsite and the written program that was provided did not adequately address protecting employees from falling while engaged in residential contraction.

29 CFR 1926.503(b)(1): The employer did not verify compliance with paragraph (a) of this section by preparing a written (training) certification record including the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer:  a.  On or about 11/28/2018, the employer failed to provide fall protection documentation for employees engaged in residential contraction and exposed to fall hazards up to 41 feet.
