On November 28, 2018, an employee was exposed to falls while working from a shop built, wooden personnel platform supported by a DynaLift D4P90 rough terrain forklift when the platform was not designed by a qualified person.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. On November 28, 2018, an employee was exposed to falling from the roof to the second floor exterior deck while installing snow guards when he was not directly above the personnel platform and was not using a personal fall arrest system.
