29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: At HEMCO Corporation 711 S. Powell Road Independence MO, on 7 May 19, the employer failed to establish a Hearing Conservation Program. Employees were exposed to continuous noise levels higher than 85 dBA in the following areas: (a) Grinding area: An employee was exposed to continuous noise level at 76.2% dose of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 88 dBA. The sampling was performed for 469 minutes during one shift; exposure calculations included a zero increment for the 73 minutes not sampled. (b) CNC Machine : An employee working at the CNC Machine was exposed to continuous noise level at 73% dose of the allowable 8-hour time-weighted average sound level of 85 dBA or an equivalent sound level of approximately 87.73 dBA. The sampling was performed for 501 minutes during one shift.
