29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.    On November 29, 2018, located at 4003 Arbor Creek Ct., Montgomery, OH, an employee was observed climbing out of a trench box located inside a 10' deep excavation that had not been trained on the applicable procedures or regulation to minimize those hazards associated with trenching and excavation such as but not limited to cave-in protection, and means of egress.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.651(c)(2): Means of egress from trench excavations. A stairway, ladder, ramp or other safe means of egress shall be located in trench excavations that are 4 feet (1.22 m) or more in depth so as to require no more than 25 feet (7.62 m) of lateral travel for employees.    On November 29, 2018, located at 4003 Arbor Creek Ct., Montgomery, OH, an employee was observed climbing onto the spreaders of a Kundel trench box to egress an excavation that was measured to be 10' in depth by 4' in width in that there were no suitable safe means for employees to access/egress located within 25' of the excavation.
