29 CFR 1926.20(b)(1): The employer did not initiate and maintain such programs as may be necessary to comply with this part: (a) At the inspection site, exposing employee(s) to conditions which are unsanitary, hazardous, or dangerous to their health or safety.   Note: The elements of an effective safety and health program may include, but are not limited to, the following:  a) Management commitment and leadership  b) Assignment of Responsibility  c) Identification and control of hazards  d) Training and education  e) Recordkeeping and hazard analysis  f) First aid, medical training and assistance  g) Frequent and regular inspections    On or about November 30, 2018, at the worksite located at 9891 NW 43rd Terrace, Doral, Florida 33178, the employer did not implement an effective safety, health and accident prevention program at a worksite where employees were engaged in roofing activity, thus exposing the employees to fall hazards.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width, each employee was not protected by use of a monitoring system.    On or about November 30, 2018, at the worksite located at 9891 NW 43rd Terrace, Doral, Florida 33178, an employee while removing roofing tiles on a low-slope roof did not have a means of fall protection and was exposed to a fall hazard of 17 feet 2 inches to the concrete patio floor below the edge of the roof.
