29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: This violation occurred on September 18, 2018 when the employer did not develop and administer a hearing conservation program as described in 29 CFR 1910.95(c) through (o) for employees exposed to noise that exceeded an 8-hour time-weighted average (TWA) of 85 decibels: (a) A stacker was exposed to continuous noise levels at 114.8% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 114.8% is approximately 91.0 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 84.6 dBA to account for the extended shift of more than 8 hours; (b) A chain saw operator was exposed to continuous noise levels at 135.3% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 135.3% is approximately 92.1 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 84.7 dBA to account for the extended shift of more than 8 hours; (c) A lathe operator was exposed to continuous noise levels at 63.9% of the permissible 8-hour time weighted average (TWA). The equivalent decibel (dBA) level of 63.9% is approximately 86.7 dBA. Sampling was performed for 498 minutes during one shift. The action level was adjusted from 85.0 dBA to 84.7 dBA to account for the extended shift of more than 8 hours.
