29 CFR 1926.701(b): All protruding reinforcing steel, onto and into which employees could fall, was not guarded to eliminate the hazard of impalement: a) 3rd Floor - While accessing and egressing a portable extension ladder through an unfinished elevator shaft, employees were exposed to impalement hazards due to unguarded rebar, on or about November 29, 2018. Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6 m) above a lower level shall be protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, positioning device systems or fall restraint systems: a) 3rd Floor - Employees were observed plumbing up steel columns and were not protected from an approximate 22 foot fall hazard to the ground below, on or about November 29, 2018. Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
