29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l): On or about November 29, 2018, at the jobsite a forklift truck operator was operating an all-terrain forklift truck without proper training or evaluation by a qualified person. Employees were exposed to struck-by hazards.

29 CFR 1926.502(d)(23): Personal fall arrest systems were attached to guardrail systems or to hoists: On or about November 29, 2018, at the jobsite employees working on top the roof of a building approximately 18 feet above the ground were observed were wearing personal fall arrest systems tied off to the guardrail of an extensible boom platform in an elevated position. The employees were exposed to fall hazard.
