OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of being struck by vehicles while elevated on automotive lifts.    On or about 1 December 2018, and at times prior thereto, the employer did not furnish employment and a place of employment which were free of the hazard of being struck while working underneath or around vehicles that were elevated on automotive lifts.  A 2015 Ford Transit was undergoing recall work using wooden chocks when it was shifted into gear crushing the employee between the undercarriage and the front jack of the lift.  Additionally, the lift inspections that were performed did not follow all of the recommended guidelines to ensure the lifts were properly maintained and functioning.    Recommended abatement action:  Among other methods, feasible and acceptable means of abatement would include:  Follow the Rotary Lift Operation and Maintenance Manual and the Automotive Lift Institute, Lifting It Right Safety Manual to ensure manual triangular wheel chocks and stops are used.  2) Follow all the guidelines of ANSI/ALI ALOIM:2000, American National Standard for Automotive Lifts-Safety Requirements for Operation, Inspection, and Maintenance, which states the frequency with which inspections should be performed is annually by a qualified lift inspector.

29 CFR 1904.39(a)(1): The employer did not report within 8-hours the death of an employee resulting from a work-related incident.    The employer did not report a work-related fatality that occurred on 1 September 2018 at approximately 8:15 AM within the main shop floor located at 1351 Earl Rudder Freeway S, College Station, Texas. Instead, the Occupational Safety & Health Administration was notified on 3 December 2018 and approximately 12:30 PM by phone. An employee was performing safety recall work when the van came off the lift, crushing the employee between the lift jack and the underside of the van.
