29 CFR 1926.20(b)(2): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part; such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.  On December 6, 2018 at 325 E Main Street in Hortonville, the employer did not ensure that a competent person was performing frequent and regular inspections that could have recognized the fall from elevation hazards associated with employees working from scaffold platforms without utilizing a complete fall protection system and standing on materials to extend reach from the scaffold platform.

29 CFR 1926.451(f)(14): Makeshift devices, such as but not limited to boxes and barrels, shall not be used on top of scaffold platforms to increase the working level height of employees.  On December 6, 2018 at 325 E Main Street in Hortonville, an employee was standing on a twenty inch high bundle of foam board which was positioned on a scaffold platform nineteen and one half feet above surface level.

29 CFR 1926.451(g)(4)(i): Guardrail systems shall be installed along all open sides and ends of platforms. Guardrail systems shall be installed before the scaffold is released for use by employees other than erection/dismantling crews.  a)  On December 6, 2018 at 325 E Main Street in Hortonville, employees were working from a scaffold platform nineteen and one half feet above surface level without a complete fall protection system installed; end guards and mid-rails had not been installed.  b) On December 6, 2018 at 325 E Main Street in Hortonville, an employee was working from a scaffold platform thirteen feet above surface level without a complete fall protection system installed; end guards and mid-rails had not been installed.

29 CFR 1926.454(a)(1): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards including the nature of any electrical hazards, fall hazards and falling object hazards in the work area.  On December 6, 2018 at 325 E Main Street in Hortonville, the employer did not provide required scaffold safety training for employees who did not associate fall from elevation hazards when working from scaffold platforms without end guards and mid-rails installed.

29 CFR 1926.454(b)(2): The employer shall have each employee who is involved in erecting, disassembling, moving, operating, repairing, maintaining, or inspecting a scaffold trained by a competent person to recognize any hazards associated with the work in question including the correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question.  On or about December 6, 2018 at 325 E Main Street in Hortonville, the employer did not provide required scaffold assembly/disassembly safety training for employees who did not associate fall from elevation hazards during scaffold assembly with three platform levels without a fall protection system on any level.
