29 CFR 1926.251(a)(2)(ii): Rigging equipment was loaded in excess of its rated capacity: (a)Henry Carlson Construction, LLC at 305 West 4th Street, Sioux Falls, SD 57104: On or about and at times prior to December 5, 2018, the exposing employer did not ensure that under-the-hook rigging equipment was used per the manufacturer's recommendations and would not be used in excess of its rated capacity. On December 5, 2018, the exposing employer was utilizing an Eclipse LM0500 Ultralift 500kg lifting magnet in conjunction with a 300-ton lattice boom crane to lift and maneuver angle iron into place on the fifth floor of the Minnehaha County Jail Expansion which was under construction. A 392-pound piece of angle iron measuring approximately 236 inches in length was lifted by the magnet when it struck a bolt that was protruding from a precast panel causing the angle iron to separate from the magnet and fall. The angle iron struck an employee resulting in injuries. . The manufacturer of the magnet limits the length of material being lifted at 78 inches in length. The exposing employer did not follow the manufacturer's recommendations for the magnet and ensure that the angle iron being lifted did not exceed the maximum length requirements and prevent the magnet to be used in excess of it's rated capacity. This hazard exposed employees to struck-by and fall hazards.
