29 CFR 1926.451(c)(2)(ii): Unstable objects were used to support scaffolds or platform units:  a) East side of the structure: On or about 12/06/2018, and at times prior, the employer exposed employees to fall hazards, in that multiple sections of the tubular welded frame scaffold had the base plate and mud sill supported by CMU blocks while employees were working at heights of up to fifteen feet during overhand bricklaying operations.

29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:   a) East side of the building, On or about 12/06/2018, and at times prior, the employer exposed employees to fall hazards of up to fifteen feet, in that a guardrail system was not provided to employees on the tubular welded frame scaffold while moving tools, equipment, and materials to prepare the worksite for overhand bricklaying.

29 CFR 1926.451(g)(1)(vi): Each employee performing overhand bricklaying operations from a supported scaffold was not protected from falling from all open sides and ends of the scaffold (except at the side next to the wall being laid) by the use of a personal fall arrest system or guardrail system (with minimum 200 pound toprail capacity).   a) East side of the building, On or about 12/06/2018, and at times prior, the employer exposed employees to fall hazards of up to eleven feet from the tubular welded frame scaffold, in that employees were not protected with personal fall arrest systems or guardrails on the open ends of the supported scaffolds while conducting overhand bricklaying with CMU block.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer shall fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section:  (a) East side of the structure: On or about 12/06/2018, and at times prior, the employer exposed employees to silica exposure while cutting bricks, in that the Stihl TS420 cut-off saw was not equipped with an integrated water delivery system while dry cutting bricks on the tubular welded scaffold platform.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:  (a) East side of structure: On or about 12/06/2018, and at times prior, employees were permitted to perform outdoor brick cutting operations on the scaffold platform using a Stihl 14-inch cut-off saw and other employees were permitted to walk and work in close proximity to the cutting area.
