29 CFR 1910.178(p)(1): Powered industrial truck(s) (PITs)with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s): JOB SITE: 1006 Peach Street, Poplar Bluff, MO 63901, on or about 12/11/2018k, in the lumber yard, powered industrial truck (PIT) operators were permitted to operate the equipment with defects and were exposed to a struck-by hazard. The following defective PITs were on site: 1. Green 8K Mitsubishi Powered Industrial Truck, Model: FD30K, S/N: AF14835206 without a functioning rear light, horn, defective emergency brakes, and the ROPS frame on the driver's right front was broken in two pieces 2. Yellow Ford frontend loader, Model 3555B, with a broken bucket hinge.

The ROPS on the Mitsubishi Powered Industrial Truck, Model: FD30K, S/N: AF14835206, frame was broken in two pieces.
