29 CFR 1910.28(b)(1)(i): Each employee on a walking/working surface having an unprotected side or edge which was four feet (1.2m) or more above a lower level was not protected from falling by one or more of the following; A) guardrail systems; B) safety net systems; and C) personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: a) Site - On or about 12/07/18 and at times prior thereto tank truck drivers accessed the loading platform where the borders were not protected, exposing workers to 5.0 ft. 8.0 in. falls onto the concrete floor. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET).

29 CFR 1910.132(a): Protective equipment was not used when necessary whenever hazards capable of causing injury and impairment were encountered: a) Site - On or about 12/07/18 and at times prior thereto tank truck drivers climbed on top of the tanks to transfer fuel without the use of fall protection equipment, and were exposed to 10 ft. falls onto the concrete floor. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
