OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing or struck by hazards:    a. Site - On or about December 5, 2018, employees were exposed to crushing and struck by hazards while working in close proximity or underneath the Bend-Pak, Inc. 4-post auto lift which was not adequately inspected and / or maintained.

29 CFR 1910.147(c)(4)(ii): The procedures did not clearly and specifically outline the scope, purpose, authorization, rules, and techniques to be utilized for the control of hazardous energy, and the means to enforce compliance including, but not limited to, 29 CFR 1910.147(c)(4)(ii)(A-D):    Instance a. Shop - On or about December 5, 2018, the employer failed to implement and enforce a control procedure specifically designed for the (Leadwell CTC - 30 BPL Lathe machine) to ensure that all energy sources were located, isolated, locked / tagged out prior to allowing repairs or maintenance procedures to begin.      Instance b. Shop - On or about December 5, 2018, the employer failed to implement and enforce a control procedure specifically designed for the (Leadwell LTC -50BXL Lathe machine) to ensure that all energy sources were located, isolated, locked / tagged out prior to allowing repairs or maintenance procedures to begin.      Instance c. Shop - On or about December 5, 2018, the employer failed to implement and enforce a control procedure specifically designed for the (Leadwell MCV-1000 Lathe machine) to ensure that all energy sources were located,  isolated, locked / tagged out prior to allowing repairs or maintenance procedures to begin.      Instance d. Shop - On or about December 5, 2018, the employer failed to implement and enforce a control procedure specifically designed for the (Leadwell MCV-1300P Lathe machine) to ensure that all energy sources were located,  isolated, locked / tagged out prior to allowing repairs or maintenance procedures to begin.
