29 CFR 1926.20(b)(2): Such programs shall provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers.    On December 11, 2018 located on the east side of an exterior commercial structure, an employee was exposed to a fall hazard while performing work from inside an aerial lift basket not wearing a harness and lanyard attached to the basket. The employer did not designate a competent person to provide frequent and regular inspections to ensure the job-site, materials, and equipment such as fall protection systems and/or devices were being maintained and utilized in a safe condition. Potential fall height measured to be 12 feet.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.

29 CFR 1926.453(b)(2)(v): A body belt shall be worn and a lanyard attached to the boom or basket when working from an aerial lift.  Note to paragraph (b)(2)(v): As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system. The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated under 1926.502(e).    On December 11, 2018, located on the east side of a commercial exterior structure, an employee was exposed to a fall hazard while working inside a JLG Boom Lift basket Model# 460SJ without being attached to the boom or basket. Potential fall height was measured to be 12 feet.

29 CFR 1926.454(a): The employer shall have each employee who performs work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards:    On December 11, 2018, located on the east side of an exterior commercial structure, an employee was exposed to a fall hazard not wearing a harness and lanyard attached to the basket while performing work from inside a JLG Boom Lift basket Model# 460SJ in that the employee had not receive training to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.    In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence, or written records.
