29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):    a) Worksite, 137 Montauk Highway, Quogue, NY (Roof of Residential Building) -  Employees were doing chimney removal work on a residential building approximately 14ft. 6in. above the ground with no fall protection; on or about 12/12/2018.    Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a) Worksite, 137 Montauks Highway, Quogue, NY (Roof of Residential Building) - Employees were using an portable WERNER extension ladder to access the roof approximately 14ft. 6in. above the ground below. The ladder side rails extended approximately 2ft. above the landing surface, on or about 12/12/2018.    Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.

29 CFR 1926.1053(b)(9): The area around the top and/or bottom of (a) ladder(s) was not kept clear:    a) Worksite, 137 Montauk Highway, Quogue, NY (Roof of Residential Building) - The area around the top of the portable WERNER extension ladder approximately 14ft. 6in. above the ground was not kept clear of material and equipment such as but not limited to sheets of plywood and  power cords; on or about 12/12/2018.     Note:  In addition to abatement certification, the employer is required to submit abatement documentation for this item in accordance with 29 CFR 1903.19.
