29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system.  The use of a body belt in a tethering system or in a restraint system is acceptable and is regulated.  1) Worksite, 740 Country Rd. 39-A, Southampton, NY - Employees were using a JLG Telescopic Boom Lift, Model No. 600S/Serial No. 0300193892, to access the roof of a commercial building approximately 25ft. above the ground. The employees were lowered by the platform and were not protected from falling; on or about 12/12/2018.   Note:  The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) Worksite, 740 Country Rd 39-A, Southampton, NY - Employees were doing roofing work on a commercial building approximately 25ft. above the ground below without fall protection; on or about 12/12/2018.   Note: Because abatement of this violation is already documented in the case file, the employer need not submit certification or documentation of abatement for this violation as normally required by CFR 1903.19.
