29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): (a) The employer did not assess work tasks preformed in the returns area that required employees to work on or around potentially damaged lithium Ion batteries and the associated equipment. Employees responsible for repackaging return shipments were not protected from battery liquids and gases, and electrical arc, exposing employees to chemical, fire and explosion hazards.

29 CFR 1910.1200(h)(2)(ii): The employer did not provide information to the employees on operations in their work area where hazardous chemicals were present: (a) The customer returns staging area: Employees were not provided effective information on the operations in their work place, where hazardous chemicals were a part of the product being staged. Employees were not aware of the presence of chemicals and how to handle said chemicals, to include being prepared to react to chemical release from ruptured or damaged Lithium Ion batteries as a part of product return. This includes, but is not limited to an event that resulted in employee(s) receiving medical treatment after an exposure that occured on or about November 28, 2018. This exposed employees to inhalation and Chemical burn hazards.
