29 CFR 1926.501(b)(2)(i): Each employee who was constructing a leading edge 6 feet (1.8m) or more above lower levels was not protected from falling by guardrail systems, safety net systems, or personal fall arrest systems:      a)  There were no guardrails at the edge of the 4th fl top deck and employees were not provided/ using fall protection PFAS (FP harness tied to lifeline); employer was constructing the top deck for a concrete pour.       Location: 91 Clay Street, Brooklyn NY      On or about 12/7/2018       NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1,000.00 AS PER 29 CFR 1903.19.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings was not protected from falling by use of a guardrail system, safety net system, or personal fall arrest system; (when the lower edge of the wall opening is less than 39 inches above the work surface and the fall hazard is greater than 6 feet):      a)   Elevator shaft entrances at the 3fl and 2fl were not fully guarded; employees were exposed to fall hazard to 20 ft during construction activities. 29 CFR 1926.1052(b)(1): Foot traffic was permitted on metal pan stairways before the tread pans and landing pans were temporarily fitted with wood or other solid material at least to the top edge of each pan:      a)  The stair pans were not filled on the stair to the 4th floor; employees are exposed to trip/fall hazard when using the stair during construction activities.
