29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l) (Construction reference 1926.602(d)):    a)  At 6305 Crescent Dr. Norcross GA, 30093: On or about December 13, 2018 and at times prior to, the employer exposed employees to hazards associated with employees operating a rough terrain forklift without ensuring that operators had been successfully trained including, but not limited to formal instruction and practical training.  Employees used a JBC forklift, Serial Number 10851089 to lift materials and lower trash from the roof.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury:    a. On or about December 13, 2018 and at times prior to, employees working on the roof were exposed to fall and struck-by hazards. The employer did not provide training to the employees operating an All-Terrain Vehicle (ATV) with a trailer hitch on a 20,000 square foot flat roof transporting material.  The owner's operator manual was not provided for employees use and employees were not familiar with the hazards and means to control the hazards associated with using the ATVs.

The employer allowed employees to remove debris on damaged areas of the roof, exposing the employees to fall hazard of about 40-feet.

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous:      a) On or about December 13, 2018 and at times prior to, employees working on the roof used an extension cord receiving power from a generator to power equipment including but not limited to, cell phones and light fixtures.  The ground pin was broken off from the attachment plug, exposing employees to injuries from electrical shock.
