29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift:  (a) Holiday Inn Express, Front Side/Roof: On or about 12/13/2018, the employer exposed employees to ejection/fall hazards of over 57-feet, 4-inches to the lower level, in that a fall arrest system was not provided to employees using the Genie Z-80 Aerial Lift as a means to access the roof and ground levels.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  a) Holiday Inn Express, Roof: On or about 12/13/2018, the employer exposed employees to fall hazards of over 57-feet, 4-inches to the lower level, in that a fall protection system was not provided to employees engaged in concrete cutting activities in close proximity to the edge.

29 CFR 1926.1153(c)(1): For each employee engaged in a task identified on Table 1, the employer did not fully and properly implement the engineering controls, work practices, and respiratory protection specified for the task on Table 1, unless the employer assesses and limits the exposure of the employee to respirable crystalline silica in accordance with paragraph (d) of this section.  (a) Holiday Inn Express, Roof: On or about 12/13/2018, and at times prior, the employer exposed employees to silica exposure while cutting concrete, in that the STIHL TS-420 cut-off saw was not equipped with an integrated water delivery system while dry cutting concrete to prepare for metal columns on the pre-cast hollow core roof slab.

29 CFR 1926.1153(d)(2)(i): The employer did not assess the exposure of each employee who was or may reasonably be expected to be exposed to respirable crystalline silica at or above the action level in accordance with either the performance option in paragraph (d)(2)(ii) or the scheduled monitoring option in paragraph (d)(2)(iii) of this section:   (a) Holiday Inn Express, Roof: On or about 12/13/2018, employees were permitted to perform outdoor concrete cutting operations on the roof of the hotel using a STIHL 14-inch cut-off saw and other employees were permitted to walk and work in close proximity to the cutting area.
