29 CFR 1926.20(b)(2): The employer did not initiate and maintain programs which provided for frequent and regular inspections of the job site, materials and equipment to be made by a competent person:  (a)Quality Builders, Inc. at 27077 South Tallgrass Avenue, Sioux Falls, SD 57108:  On and prior to December 13, 2018, the exposing employer did not ensure an accident prevention program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees were exposed to fall hazards, eye hazards, and struck-by hazards. This condition exposed construction related hazards that could have been identified by a competent person during a frequent and regular inspection of the job-site.  Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.102(a)(1): The employer did not ensure that each affected employees used appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:  (a)Quality Builders, Inc. at 27077 South Tallgrass Avenue, Sioux Falls, SD 57108: On or before and at times prior to December 13, 2018, the exposing employer did not ensure that employees were protected from eye injuries in that employees were utilizing pneumatic nail guns for installation of roof trusses with no eye protection. This condition exposed employees to a projectile hazard to the eyes.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  (a)Quality Builders, Inc, at 27077 South Tallgrass Avenue, Sioux Falls, SD 57108: On or about and at times prior to December 13, 2018, the exposing employer did not ensure that all forklift operators were trained in the operation of powered industrial trucks in that, the operators were not trained in the use of the Ingersoll-Rand VR-642C rough terrain forklift prior to its use. This condition exposed the employees to the hazard of improper forklift operation.    Abatement Note: Training shall consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance.

29 CFR 1926.251(a)(1): Rigging equipment for material handling was not inspected prior to use on each shift and as necessary during its use to ensure that it was safe:  (a)Quality Builders, Inc. at 27077 South Tallgrass Avenue, Sioux Falls, SD 57108: On or about and at times prior to December 13, 2018, the exposing employer did not ensure the rigging used was inspected to ensure it was safe prior to use. The employer allowed employees to use a nylon strap with observed defects to include severe fraying and discoloration. The rigging was connected to the stinger boom on the forklift and used to provide materials to the job-site. This condition exposed employees to a struck-by hazard.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employees provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a)Quality Builders, Inc, at 27077 South Tallgrass Avenue, Sioux Falls, SD 57108: On or about and at times prior to December 13, 2018, the exposing employer did not ensure that employees were protected from falls while installing trusses on a single-family home under construction. Employees were working top plates on the interior and exterior walls with no fall protection systems in place. This condition exposed employees to a fall hazard of over six feet.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:   (a)Quality Builders, Inc, at 27077 South Tallgrass Avenue, Sioux Falls, SD 57108: On or about and at times prior to December 13, 2018, the exposing employer did not ensure that each employee engaged in framing operations on a single-family home, had been trained to recognize the hazards associated with working at elevations over 6 feet. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards. Employees working on-site had not received fall protection training before working at elevations over 6 feet. The employer did not provide training on the simple saver fall protection system involving it's limitations and use. The condition exposed employees to the hazard of falling from an elevation of approximately 12 feet and 19 feet.
