29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502.     On or about December 13, 2018, during the installation of metal flashing material on a low slope (flat) roof, during the construction of a townhouse, located at the corner of West 117th Street and Lake Avenue, Cleveland, Ohio, the employer did not ensure employees were protected from a fall of approximately 3 stories (roof to ground) by utilizing a guardrail system, fall protection system, and/or combination of warning line system and safety monitor system.         TARHEEL CONSTRUCTION, INC., WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD, 29 CFR 1926.501(b)(10), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1015651, CITATION NUMBER 01, ITEM NUMBER 001B, AND WAS AFFIRMED AS A FINAL ORDER ON MARCH 5, 2015 WITH RESPECT TO A WORK PLACE LOCATED AT 2839 FRANKLINE BLVD, CLEVELAND, OHIO.
