29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or another provision in paragraph (b) of this section which provides for an alternative fall protection measure:    (a) M & S Horner Painting, Inc., at 1760 35th Ave Pl in Greeley, CO: On or before December 14, 2018, the exposing employer did not ensure that each employee engaged in residential construction were protected from injury, in that employees were masking and taping while on the roof of a one and two story house and were not utilizing a fall protection system.  This condition exposed the employees to approximately ten to twenty five foot fall hazards.

29 CFR 1926.501(b)(4)(ii):  Each employee on a walking/working surface was not protected from tripping in or stepping into or through holes (including skylights) by covers:  (a) M & S Horner Painting, Inc., at 1760 35th Ave Pl in Greeley, CO: On or before December 14, 2018, the employer did not ensure that employees were protected from stepping into or through holes by covers. Employees were exposed to an egress window below the work area on the south side of the house, causing a tripping hazard.  The hole measured approximately 3 feet long, 3 feet wide, and 44 inches deep. This condition exposed employees to a trip hazard as it was located within the work area.

29 CFR 1926.1053(b)(6): Ladders were not secured to prevent accidental displacement when used on surfaces which were not stable and level:    (a) M & S Horner Painting, Inc., at 1760 35th Ave Pl in Greeley, CO: On or before December 14, 2018, the employer did not ensure that ladders were secured when used on unstable surfaces, in that an employee was injured when the ladder he was working on slipped causing the employee to fall, hit a railing, bounce then hit to the ground. The base of the extension ladder was placed on top of rocky, clayey soil. This condition exposed the employee to a fall of approximately 14 feet to the ground below.

A portable ladder was used for access to an upper landing, and the ladder side rails did not extend at least 3 feet above the upper landing, and was not secured:  (a) M & S Horner Painting, Inc., at 1760 35th Ave Pl in Greeley, CO: On or before December 14, 2018, the employer did not ensure that portable extension ladders, used to access the roof of the residential home, had side rails extending 3 feet above the upper landing, and was secured.  Employees accessed the roof by using extension ladders on the west side of the house. The ladder was placed approximately two above the landings. This condition exposed employees to a fall hazard of approximately 10 feet to the ground below.
