29 CFR 1926.20(b)(2): The employers existing safety program did not provide for frequent and regular inspections by a competent person(s) of the job site, materials and equipment. (a) On or about, and times prior to, December 6, 2018, at the above referenced inspection site, subcontracted employees engaged in elevated work on or around skylights and were not protected from falls. The employers existing safety plan did not recognize, and control hazards associated with subcontractors demolition activity, guarding of skylights, and lifeline installation, thereby allowing employees to be exposed to fall hazards.

29 CFR 1926.501(b)(4)(ii): Each employee on a walking/working surface shall be protected from tripping in or stepping into or through holes (including skylights) by covers. (a) On or about, and at times prior to, December 06, 2018, at the above referenced inspection site, subcontracted employees engaged in demolition activities and were not protected from tripping in or stepping through skylights. The employer did not ensure that the subcontractor covered the flush mounted translucent fiberglass skylights, thus allowing employees to be exposed to fall hazards.
