29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: (a) On December 17, 2018; at least one employee was working while kneeling at the edge of a flat roof handing asphalt shingles down to a coworker who was installing them to the steep sloped mansard roof of a single story commercial building at 11411 North Central Expressway, Dallas, TX. The employee was approximately eighteen (18) feet above the ground below and was not protected from a fall hazard by using either guardrail systems, safety net systems, or personal fall arrest systems. (b) On December 17, 2018; at least one employee was working while standing on an approximately 8 inch wide ledge installing shingles to the mansard roof of a commercial building at 11411 North Central Expressway, Dallas, TX. The employee was approximately fifteen (15) feet or more above the ground below and was not protected from a fall hazard by using either guardrail systems, safety net systems, or personal fall arrest systems.

Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed; the ladder was not secured at its top to a rigid support that will not deflect, and/or a grasping device was not provided to assist employees in mounting and dismounting the ladder: (a) On December 17, 2018 at least one employee was observed using an approximately twenty-eight (28) foot aluminum extension ladder on the North side of a Commercial building located at 11411 North Central Expressway, Dallas, TX. The top of the ladder was only approximately 1 foot and 6 inches above the upper landing thereby exposing the employee using it to a fall hazard of approximately fifteen (15) feet to the concrete parking lot below.
