29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets. On the east side of the construction site, employees engaged in cornice activities were not wearing hard hats while working below the worker were exposed to struck-by hazards of falling tools and materials.

29 CFR 1926.1053(b)(13): The top or top step of a stepladder was used as a step. On the east side of the construction site, employees use the top step of a 6 foot A-frame ladder to access and egress the pole scaffold to install cornice material and were exposed to fall hazards.
