29 CFR 1926.1101(d)(2): Asbestos hazards at a multi-employer work site were not abated by the contractor who created or controlled the source of asbestos contamination:      The employer is failing to prevent employee exposure to asbestos hazards associated with abatement and removal activities. The condition was most recently observed on or about  November 2nd, 2018 at the facility located at 137 Hale Library, Manhattan, KS 66506. The negative air containment areas were erected and put in place by Belfor representatives. Due to this fact, the responsibility of making sure the enclosures stay in tact and in proper working condition falls upon them. The enclosures had many flaws including but not limited to gaps at the ceiling, gaps near the floor, holes in the plastic sheeting and improperly sealed entrance/exits.

29 CFR 1926.1101(d)(5): As supervisor of the entire project, the general contractor did not ascertain whether the asbestos contractor was in compliance with the asbestos standard, and did not require such contractor to come into compliance with this standard:      The employer is failing to protect workers from asbestos exposure hazards associated with abatement and removal activities . The condition was most recently observed on or about  November 2nd, 2018 at the facility located at 137 Hale Library, Manhattan, KS 66506 . The employer did not ensure that the contractor performing asbestos work was in compliance with the 1926.1101 standard including but not limited to: training, prohibiting dry sweeping, not using wet methods, breaking and removing the tile not intact.

29 CFR 1926.1101(k)(3)(iii): Within 10 days of the completion of work covered by 29 CFR 1926.1101, the employer whose employees performed the work, did not inform the building/facility owner and/or employers of employees who will be working in the area of the current location and quantity of presumed asbestos containing material and/or asbestos containing material remaining in the area and the final monitoring results, if any:      The employer is failing to prevent employee exposure to asbestos hazards associated with abatement and removal activities. The condition was most recently observed on or about February 26th, 2019 at the facility located at 137 Hale Library, Manhattan, KS 66506. The general contractor did not inform all employers and employees working in the library of the final results after abatement was completed but the cleanup process was incomplete. Employers and employees were working around asbestos without knowledge of final monitoring results and where the ACM was still in the building.
