29 CFR 1910.28(b)(1)(i): 29 CFR 1910.28(b)(1)(i): (1) Unprotected sides and edges: (i) Except as provided elsewhere in this section, the employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet or more above a lower level was protected from falling by one or more of the following: (A) Guardrail systems; (B) Safety net systems; or (c) Personal fall protection systems, such as personal fall arrest, travel restraint, or positioning systems: (a) Blue Sky Plumbing & Heating, Inc. at 115 Cherry Street Louisville, CO 80027: On or before 12-13-18 the exposing employer did not ensure that an employee was protected from falling when performing maintenance on a residential metal roof. An employee accessed a metal roof with a slope of approximately 4.5/12 to replace a vent cap. The employee fell 9.9 feet from the eave to the ground, and sustained a back injury. This condition exposed this employee to a fall hazard of 9.9 feet.

29 CFR 1910.30(a)(1): Before any employee is exposed to a fall hazard, the employer did not provide training for each employee who uses a personal fall protection system, or who is required to be trained as specified elsewhere in this subpart: (a) Blue Sky Plumbing & Heating, Inc. at 115 Cherry Street Louisville, CO 80027: On or before 12-13-18, the exposing employer did not ensure that an employee was trained on the use of fall protection when performing maintenance on a residential metal roof. An employee accessed a residential metal roof with a slope of approximately 4.5/12 to replace a vent cap, without adequate fall protection training. The employee fell 9.9 feet from the eave to the ground, and sustained a back injury. This condition exposed this employee to a fall hazard of 9.9 feet.
