OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to hazards including but not limited to shock from bleeding.     a)  At Marathon Galveston Bay Refinery, Power 2 South of Pipe Stills & Avenue G:  On or about October 30, 2018, an employee sustained a deep laceration resulting in uncontrolled bleeding.  The employer failed to properly evaluate the injury and follow medical advice resulting in significant delay in stopping the uncontrolled bleeding and initiation of appropriate medical attention.

Located at the Marathon Galveston Bay Refinery establishment, the employer did not record the following workplace injury correctly on the OSHA 300 Log for calendar year 2018.    a) On or about October 30, 2018 a scaffold builder sustained a laceration requiring surgery and hospitalization; resulting in the inability to perform primary duties.  The injury was recorded as other recordable cases even though the injury resulted in days away and restricted work activity.

29 CFR 1904.29(b)(2): The employer did not fill out or correctly fill out an OSHA Form 301 or equivalent for each recordable injury or illness.  Located at the Marathon Galveston Bay Refinery establishment, the employer did not record the following workplace injury correctly on the OSHA 300 Log for calendar year 2018.    a) On or about October 30, 2018 a scaffold builder sustained a deep laceration when an employee attempted to cut a zip tie off his pants with a knife. The injury was recorded as a laceration requiring stiches in block 16 even though the injury required hospitalization and surgical repair by a hand specialist.   b) On or about October 30, 2018 a scaffold builder sustained a deep laceration when an employee attempted to cut a zip tie off his pants with a knife.  The injury description in block 14 described the injured employee was having another worker cut a piece of tie-wrap on his backside; however, the injured employee was unaware of the foreman's intent or action involving the use of a pocket knife constituting horseplay, which resulted in a serious and debilitating injury.

The injury was recorded as other recordable cases even though the injury resulted in days away and restricted work activity.
