This forklift did have an operator restraint device (seat belt); however, employee had not buckled the seat belt across the seat and did not use the seat belt, exposing the employee to the risk of getting caught-in/between the truck and the ground in the event of a truck tip over, on or about December 19, 2018.      (b)  NO BAKE SHIPPING/FINISHING AREA - An employee operated a Komatsu 20 Series sit-down type forklift, to pick up and move material.  This forklift did have an operator restraint device (seat belt); however, the employee had not buckled and used the seat belt, exposing the employee to the risk of getting caught-in/between the truck and the ground in the event of a truck tip over, on or about December 19, 2018.      No abatement certification or documentation required.
