OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazard of getting caught-in or between a tipping forklift and the ground:    (a)  NO BAKE KNOCKOUT AREA - An employee operated a Unicarriers MUG1F2A30LV sit-down type forklift, to remove castings from molds.  This forklift did have an operator restraint device (seat belt); however, employee had not buckled the seat belt across the seat and did not use the seat belt, exposing the employee to the risk of getting caught-in/between the truck and the ground in the event of a truck tip over, on or about December 19, 2018.      (b)  NO BAKE SHIPPING/FINISHING AREA - An employee operated a Komatsu 20 Series sit-down type forklift, to pick up and move material.  This forklift did have an operator restraint device (seat belt); however, the employee had not buckled and used the seat belt, exposing the employee to the risk of getting caught-in/between the truck and the ground in the event of a truck tip over, on or about December 19, 2018.      No abatement certification or documentation required.

29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial truck were performed by the employer without the manufacturer's prior written approval:    (a)   KNOCK OUT AREA - Employees used a Unicarriers MUG1F2A30LV forklift equipped with two below-the-tines lifting chains to shake aluminum castings from molds, and the employer had not obtained the forklift manufacturer's prior written approval, on or about December 19, 2018.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.
