29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Employee(s) were exposed to chemical hazards. Employee engaged in painting activities was exposed to injury/illness from dermal, inhalation hazards from exposure to hazardous chemicals. The employer had not developed nor implemented a written hazard communication program to ensure the employee was aware of the hazards associated with the chemicals with which he works. Hazardous chemicals used at the site included but were not limited to Dryvit acrylic based paint.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59) Employee(s) were exposed to chemical hazards. Employee engaged in painting activities was exposed to injury/illness from dermal and inhalation hazards from exposure to hazardous chemicals. The employee has not been provided with training nor information regarding the hazardous chemicals with which he works. Hazardous chemicals such as Dryvit acrylic paint used at the residential construction site.
