29 CFR 1910.134(c)(1): In any workplace where respirators are necessary to protect employee health or whenever respirators are required by the employer, a written respiratory protection program that included the provisions in 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented.  On or about December 21, 2018, and at times prior thereto, employees were exposed to respiratory hazards. Employees who were required to wear respirators during tasks including but not limited to grinding carbon fiber material. The employer did not implement or provide a written respiratory protection program including but not limited to the following:  a) Ensuring employees were medically cleared to wear a respirator.  b) Ensuring employees were fit tested to wear selected respirator.  c) Training on proper use and care of respirators.

29 CFR 1910.215(b)(9): Guard for abrasive wheel machine where the operator stands in front of the machine was not constructed so that the peripheral protecting member could be adjusted to the constantly decreasing diameter of the wheel.  On or about December 21, 2018, and at times prior thereto, employees working in the machine room utilized a Craftsman 3/4 horsepower Bench Grinder to modify prosthetics and orthotics. The grinder was missing the guard on the right side exposing employees to the hazard of being struck by debris in the event of wheel failure.

29 CFR 1910.242(b): Compressed air used for cleaning purposes was not reduced to less than 30 p.s.i.  On or about December 21, 2018, and at times prior thereto, the air nozzle located near the plaster room was operated by employees at 92 p.s.i for cleaning purposes, exposing employees to the hazard of being struck by debris.

29 CFR 1910.303(g)(1): Sufficient access and working space was not provided and maintained about all electric equipment to permit ready and safe operation and maintenance of such equipment.  On or about December 21, 2018 and at times prior thereto, electrical panelboards located inside of washroom near the plaster room were blocked by stored supplies and an air compressor, exposing employees to the hazard of electrical shock.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met. The program shall address and complete the element's described in this section including, but not limited to, the following:  a) Develop a written hazard communication program with a list of hazardous chemicals known to be present in the facility and methods the employer will use to inform employees of the hazards of the chemicals; b) Ensure labeling is maintained for each chemical container, including the identity of the chemical and hazards warnings. For example some containers had no labeling and other containers were hand written as "glue" without the warnings associated with the glue. c) Maintain Safety Data Sheets (SDS) for each hazardous chemical in the workplace; d) Train employees on hazardous chemicals in their workplace on the time of their initial assignment and whenever a new chemical hazard is introduced in the employees' workplace. Employees shall be trained on the requirements of this section, operations in their work area where hazardous chemicals are present, and the location and availability of the written hazard communication program including the list of hazardous chemicals and safety data sheets.  On or about December 21, 2018, and at times prior thereto, the employer had not developed and implemented a written hazard communication program for employees exposed to such chemicals as but not limited to, Barge All Purpose Thinner and Master Quick Drying All- Purpose Cement.

29 CFR 1910.132(a): Protective equipment was not maintained in a sanitary and reliable condition.  On or about December 21, 2018, and at times prior thereto, protective equipment stored above work benches, such as but not limited to, Peltor Twin Cup Ear Muffs and Safety Glasses were not maintained in a sanitary condition. Employees were using ear muffs covered with debris from plaster and casting operation, exposing employees to health hazards.

29 CFR 1910.141(a)(3)(i): Places of employment were not kept clean to the extent that the nature of the work allowed.  On or about December 21, 2018 and at times prior thereto, plaster, power tools, chemicals, and other debris were observed throughout the Orthotist and Prosthetist work area impeding the work areas and routes to work benches, exposing employees to trip hazards.
