29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks:    On or about January 11th, 2019 and times prior thereto, employee was using a front end loader to pour mulch product onto a grinder (Make: Vermeer; Model: HG4000; Serial: 1VRC312H4D1000113).  The grinder had the thrown object deflector in a non-operating position, exposing employees to the hazard of being struck by product being ejected from the grinder.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:    On or about December 21st, 2018, the employer did not develop or implement a written hazard communication program for employees required to refuel heavy equipment, exposing employee to inhalation and absorption hazards of diesel fuel, additives and/or other chemicals.    Required program elements that were not developed and implemented include but are not limited to the following:    1910.1200(e)(1)(i): developing an inventory list of chemicals used in the workplace,  1910.1200(g): Maintaining copies of Safety data sheets (SDS),  1910.1200(h): Providing information and training to employees regarding the hazards of chemicals.
